By downloading, accessing, or using JournalMind (the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and JournalMind, Inc. ("JournalMind," "we," "our," or "us"). We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
You must be at least 13 years of age (16 in the European Union) to use JournalMind. By using the Service, you represent that you meet this age requirement. If you are under 18, you represent that you have parental or guardian consent to use the Service.
To access most features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep this information updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at support@journalmind.app if you suspect unauthorized access to your account.
Each account is for a single individual's personal use. You may not share your account with others or create multiple accounts to circumvent any restrictions or policies.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
You retain full ownership of all journal entries, notes, and other content you create within JournalMind ("Your Content"). We claim no intellectual property rights over Your Content.
By using the Service, you grant JournalMind a limited, non-exclusive, royalty-free license to store, process, and display Your Content solely as necessary to provide the Service to you, including AI-powered features. This license does not extend to any commercial use of Your Content.
You are solely responsible for Your Content. You represent that you have all necessary rights to the content you submit and that it does not violate any third-party rights or applicable laws.
You may delete Your Content at any time through the app. We will delete your content from our servers within 30 days of your request or account deletion, except where retention is required by law.
The Service, including but not limited to the app design, user interface, artwork, text, graphics, logos, software, and underlying technology, is owned by JournalMind and is protected by copyright, trademark, and other intellectual property laws.
The JournalMind name, logo, and product names are trademarks of JournalMind, Inc. You may not use these marks without our express written permission.
JournalMind offers a free plan with a core set of features available at no charge. We reserve the right to modify free plan features with reasonable notice.
JournalMind Premium is available as a monthly or annual subscription at the price displayed at the time of purchase. All prices are in USD and include applicable taxes unless otherwise stated.
Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You authorize us (or our payment processor) to charge your payment method on file.
We may offer a free trial of Premium. If you do not cancel before the trial ends, you will be charged for the subscription. You may cancel during the trial period without charge.
We may change subscription prices with at least 30 days' notice. If you do not agree to a price change, you may cancel before the change takes effect.
The Service may integrate with third-party services (e.g., Apple Health, Google Fit for mood correlations). Your use of such third-party services is subject to their respective terms and privacy policies. JournalMind is not responsible for third-party services or their practices.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, JOURNALMIND DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
JournalMind does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any AI-generated content, which is provided for informational and reflective purposes only and does not constitute professional advice.
JournalMind is not a substitute for professional mental health care. If you are experiencing a mental health crisis, please contact a qualified professional or emergency services.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JOURNALMIND AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL JOURNALMIND'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.
You agree to defend, indemnify, and hold harmless JournalMind and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms.
We may suspend or terminate your account and access to the Service at any time for any reason, including if we reasonably believe you have violated these Terms. Upon termination:
You may terminate your account at any time through Settings → Account → Delete Account.
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration administered by JAMS under its Streamlined Arbitration Rules. The arbitration will take place in San Francisco, California, or by telephone/video at your election.
You agree to resolve disputes with JournalMind individually and waive any right to bring or participate in a class action lawsuit or class-wide arbitration. You may opt out of this waiver within 30 days of first accepting these Terms by emailing legal@journalmind.app.
We may update these Terms from time to time. We will notify you of material changes by email and/or through a notice in the app. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance. If you do not agree to the changes, you must stop using the Service and may cancel your subscription for a prorated refund.
